These terms are an agreement between you and The Incorporated Trustees of Brain Builders Youth Development Initiative (CAC/IT/NO 119116) (“BBYDI”), which runs HerSafeSpace (“HSS”). By creating an account or using HSS, including Kemi on WhatsApp, you agree to these terms and to our Privacy Policy.
1. Who can use HSS
You must be at least 16 years old. By using HSS you confirm that you are. If you use HSS for an organisation, you confirm that you are allowed to accept these terms for it.
2. What HSS is, and what it is not
HSS offers information, a private vault, incident reporting, SOS alerts, and a way to contact independent lawyers. It is a free service provided by a non-profit.
- HSS is not an emergency service. If you are in immediate danger, call 112 or your local emergency number. SOS alerts are sent by text message and depend on mobile networks and on your trusted contacts. We cannot guarantee that an alert is delivered, read or acted on.
- Kemi is an AI assistant, not a person. Kemi can be wrong or incomplete. Its answers are general information, not legal, medical or psychological advice. Check important information with a qualified professional.
- Lawyers on HSS are independent. We check each lawyer’s bar licence before listing them. They are not our employees or agents. Any lawyer-client relationship is between you and the lawyer, and we are not responsible for their advice or services.
- Reports are not police reports. Filing an incident report on HSS does not report a crime to the authorities. We can help you find the right service to contact.
3. Your account
You sign in with a one-time code sent to your email or with your Google or Apple account. Keep access to your email and devices secure, and keep your vault PIN private. We cannot recover vault content if someone else learns your PIN. Tell us promptly if you think someone else has accessed your account.
4. Acceptable use
You must not use HSS to:
- harass, threaten, stalk, impersonate or harm anyone, including lawyers and HSS staff;
- file reports you know are false, or share someone’s private information to harm them;
- upload content that sexually exploits children. We report it to the authorities;
- upload malware, or attempt to access accounts, data or systems you are not authorised to access;
- overload, scrape or reverse-engineer HSS, or get around its limits or security;
- break any law that applies to you.
5. Your content
You own what you upload: messages, reports, files and photos. You give BBYDI a limited licence to store, process and display that content only as needed to run HSS for you, as described in the Privacy Policy. The licence ends when you delete the content, except for anonymised report statistics and messages the lawyer keeps (see Privacy Policy section 7).
When you share evidence of abuse, you may be sharing images or information about other people. Share it only to seek help, report, or protect yourself or someone else.
6. Trusted contacts
When you add someone as an SOS trusted contact, you confirm that they have agreed to receive emergency text messages from HSS that contain your location. You can remove a contact at any time.
7. Additional terms for lawyers
If you join HSS as a lawyer, you also agree that:
- the information and documents you provide for verification are true, and you will tell us if your licence status changes;
- you will follow the rules of professional conduct that apply to you, including confidentiality and any conflict-of-interest rules;
- you will treat users with care, will not pressure them, and will not use their data for anything other than helping them;
- we may refuse, suspend or remove your listing at our discretion, particularly if we receive a complaint about your conduct.
8. Resource hub
Guides in the resource hub are written by lawyers and by our team, and are reviewed before publishing. They are general information and may not reflect the latest law in your country. If you upload a resource, you confirm that you have the right to share it and you let us publish it on HSS.
9. Suspension and ending your use
You can stop using HSS and delete your account at any time in Settings. Lawyers can ask us to close their account by emailing [email protected]. We may suspend or close an account that breaks these terms or puts others at risk. Where it is safe to do so, we will tell you why. We may change, pause or stop parts of HSS, and will give reasonable notice when we can.
10. Disclaimers
HSS is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will be uninterrupted, error-free or suitable for a particular purpose. Nothing in these terms limits rights you have under Nigerian consumer protection law, including the Federal Competition and Consumer Protection Act 2018, that cannot be excluded.
11. Limitation of liability
To the extent the law allows, BBYDI is not liable for indirect or consequential loss, or for loss caused by a lawyer, a trusted contact, a mobile network or another third party. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.
12. Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria. Please contact us first so we can try to resolve any dispute informally. If that does not work within 30 days, the courts of the Federal Capital Territory, Abuja will have jurisdiction.
13. Changes to these terms
We may update these terms and will post the new version with a new effective date. If a change is material, we will tell you in the app or by email at least 14 days before it takes effect. If you keep using HSS after that, you accept the new terms.
